Welcome to BuzzThat ("BuzzThat", "we", "us"). These Terms of Service ("Terms") are a legal agreement between you and BuzzThat and govern your access to and use of buzzthat.com and our related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use BuzzThat (or older if your local law requires). To buy Buzz Coins or receive creator payouts you must be at least 18. By using the Service you represent that you meet these requirements and that the information you provide is accurate.
You are responsible for your account, your password, and all activity under it. Keep your credentials secure and notify us promptly of any unauthorized use. You may not impersonate others, create accounts to evade a ban, or operate accounts in a coordinated, deceptive way.
You retain ownership of the content you post ("buzzes", comments, images, and other material). By posting, you grant BuzzThat a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content for the purpose of operating and promoting the Service. You are responsible for your content and represent that you have the rights to post it.
You agree not to: post unlawful, infringing, hateful, harassing, or sexually exploitative content; spam, scam, or deceive other users; attempt to manipulate coins, boosts, or payouts; scrape, reverse-engineer, or disrupt the Service; or violate any applicable law. We may remove content and suspend accounts that break these rules.
Buzz Coins are a virtual, in-platform currency. They have no cash value, are not legal tender, and are not redeemable for money except through the creator payout process described below. Coins you purchase are licensed to you for use within BuzzThat; they are non-transferable except as the Service expressly allows (e.g., boosting, unlocking, or donating to content). We may change coin pricing, packages, or features at any time. Purchases of coins are handled by our payment processor (Stripe) and are governed by our Refund Policy.
Creators can earn coins when other users spend coins on their content (net of a platform fee shown at the time). Two protections apply to all earnings:
Payouts are issued manually, subject to a minimum threshold and our review. You are responsible for any taxes on amounts you receive, and we may require tax information before paying you. We may withhold, delay, or reverse earnings and payouts connected to fraud, disputes, chargebacks, or violations of these Terms.
BuzzThat retains a platform fee on coin spends and may charge fees for certain features. Fees are disclosed in the app and may change with notice.
We may suspend, freeze, or terminate your account and withhold associated coins or payouts if we reasonably believe you have violated these Terms, engaged in fraud, initiated a chargeback, or created risk for the Service or other users. A frozen account cannot buy, spend, or cash out coins while under review.
The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that user content is accurate.
To the fullest extent permitted by law, BuzzThat will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US $100.
You agree to indemnify and hold BuzzThat harmless from claims arising out of your content, your use of the Service, or your violation of these Terms.
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Continued use of the Service after changes take effect means you accept them.
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in California, and you consent to their jurisdiction, unless applicable law requires otherwise.
